Beta version, being reviewed by a lawyer. The wording may still change before the beta starts.
I Need My Geek: Closed Beta Terms
DRAFT. For review by a qualified lawyer before use. This is not legal advice.
In square brackets, text that starts with FILL is a value or an open decision for us to fill in (the list is
FILL-IN.md), and text that starts with LAWYER is a note for the lawyer. The Spanish version iscondiciones-beta.md. The Privacy Policy (privacy-policy.md) is part of these terms for everything about personal data. Consumer-protection law in your country (for example Spain's Ley General para la Defensa de los Consumidores y Usuarios) may give you rights that these terms cannot take away; where a term below conflicts with such a right, the right wins. [LAWYER: unfair-terms review.]
Version: [FILL: version] · Date: [FILL: date]
1. Who these terms are between
[FILL: legal name], [FILL: legal form], [FILL: NIF], [FILL: postal address], [FILL: country] ("we", "us") and you, the person who installs or uses I Need My Geek in the closed beta ("you"). Contact: [FILL: contact email].
2. What the beta is
I Need My Geek ("the service") is test software. Its helper on an older adult's computer is called "your Geek" (the installed program is called INMG Buddy inside Windows). The service also has the website ineedmygeek.ai, an optional browser add-on, the family app on a relative's phone and the phone companion. Your Geek It looks out for scams, shows how to do everyday things, and can ask a trusted family member for help. A closed beta means a small invited group is testing an unfinished product so we can improve it.
By installing or using your Geek, or by joining a family circle, you accept these terms. If you do not accept, do not use it.
3. Who may take part
- You must be 18 or older. Your Geek is not for children.
- You must have been invited by us. Invitations and installers are personal; do not pass them on.
- If someone is helping you set it up (for example your son or daughter), you are the one who agrees to what your Geek does on your computer, including what your family can see (Privacy Policy, section 5). The helper must not turn on family sharing, the microphone, "Listen in" or the browser add-on for you without you understanding and agreeing. If you are not sure you can decide, ask someone you trust, or do not use those features.
- Family members who join a circle confirm that the person invited them or asked them to, and that they will use what they see only to help that person.
- If you cannot use your Geek lawfully where you live, do not use it. The beta is offered in [FILL: markets].
4. What your Geek does, and does not, promise
- It tries to notice scams and to explain things in plain words. It can be wrong. It can miss a scam and it can warn about something safe.
- It is not a bank, a security guarantee, legal, medical or financial advice, or an emergency service. It does not replace your own judgment. If money, a code, a password or your computer's control is involved, stop and call someone you trust, or your bank, using a number you know is real.
- Your Geek never asks you for a password, a one-time code, a PIN, or card or bank details. It never asks you to pay, and it never takes remote control of your computer. If something on your screen, on the phone or in a message claims to be your Geek and asks for any of these, it is a fake: stop and call your family.
- AI answers are generated by outside services and may contain mistakes. Do not rely on them for anything important without checking.
- Your Geek may stop working, be updated automatically, or be paused or ended by us at any time during the beta.
5. What your Geek can see and do (summary)
The Privacy Policy explains this in full. In short:
- It reads window titles and the visible text of the window in front (never what you type into boxes, never password boxes).
- It sends small pieces of text, and sometimes one picture or a recording, to AI services to understand them.
- It takes a screenshot only when you ask. It uses the microphone only while you hold the talk button or have turned on "Listen in".
- It tells your family what it noticed, if you set up a family circle.
Calls. "Listen in" can hear the other person on a speakerphone call. You are responsible for using it lawfully, including telling the other person where the law requires it. [LAWYER: Spain, US all-party-consent states; we may disable this feature in the beta.]
Other people's information. Chats, emails and pages on your screen may contain other people's information. Do not use your Geek in ways that break the law or someone's rights (for example to monitor a person without their knowledge).
6. Your account, keys and devices
- There are no passwords. Your Geek, family phones and phone companion use random keys saved on the device. Keep your devices locked and your Windows account private. Anyone who can use your Windows account can read your Geek's files on that computer.
- Tell us promptly at [FILL: contact email] if a device is lost or you think a key has leaked. A family member can leave a circle, and the person can remove a family member or a phone companion, at any time.
- Do not try to get around your Geek's limits, read other people's circles, or attack our servers (see section 8).
7. Free beta, no payment
The beta is free. We do not ask for payment, card details or bank details at any point. If this changes, new terms will apply and you will be asked first.
8. What you must not do
- Use your Geek to harm, harass, deceive or spy on someone, or to monitor an adult who has not agreed.
- Send your Geek or the servers content that is illegal, or malware, or try to break, overload or reverse-engineer the service beyond what the law allows.
- Share your invitation, pairing codes or keys with strangers. Pairing codes last 15 minutes; do not give them to anyone you do not trust.
- Use test data you do not have the right to use.
We may suspend or end your access if you break these terms or put others at risk.
9. Feedback and testing
You may tell us what works and what does not. If you send feedback, ideas or reports, you allow us to use them to improve the product without payment, and without naming you unless you agree. Do not send other people's private information in feedback. [LAWYER: optional confidentiality of unreleased features.] We may ask you to answer short questions or to share a recording or screenshot of a problem; that is always your choice. If you press "Send my log" in the app, the last 7 days of your Geek's activity log (names, secrets and email addresses masked on your computer first) are sent to us for a problem report, kept 30 days and read only by us. [LAWYER: new today]
10. Our rights in the software
Your Geek, its text, designs and software belong to us or our licensors. During the beta we give you a personal, non-exclusive, non-transferable, revocable license to install and use it on your own computer and phone for testing. You may not copy, sell, rent or build on it beyond that, except where the law says you may. Open-source parts remain under their own licenses. [LAWYER: list.]
11. Personal data
We handle personal data as set out in the Privacy Policy [FILL: privacy policy URL]. It tells you what is kept where, for how long, which AI services receive which words, what your family can see and how to ask us to delete your data. If you join the waitlist on our website we use your email to send you a confirmation and a welcome message and to invite you to the beta; every message has a link that deletes your entry. [LAWYER: new today] Contact: [FILL: privacy email]. We act as controller [LAWYER: or in the role the lawyer decides].
12. Our responsibility
- We take care, but it is a test product. It is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free, or that it will detect every scam.
- What we cannot exclude. Nothing in these terms limits liability that cannot lawfully be limited (for example for death or personal injury caused by negligence, fraud, wilful misconduct, or consumer rights that cannot be waived).
- Otherwise, to the extent the law allows, we are not liable for losses that were not reasonably foreseeable, for lost profits or data, or for losses that arise because you ignored a warning, followed a scammer, or relied on your Geek instead of your own judgment or your bank. Our total liability to you for the beta is limited to [FILL: liability cap], except where the law forbids a limit. [LAWYER.]
- We are not responsible for outside services (AI providers, push services, your internet, your phone maker), for third parties who scam you, or for the other person on a call.
- Family members make their own decisions. If a relative says "It's OK" or "Keep it stopped", that is their choice, not ours.
13. Ending the beta
You may stop at any time: uninstall your Geek and delete its folder (the Privacy Policy explains how), leave your circle, and tell us if you want your data deleted. We may end the beta or your access at any time, with [FILL: notice period] where possible. When the beta ends we will [FILL: delete or export] beta data within [FILL: days after beta ends]. Sections that by their nature should continue (for example 9, 10, 12 and 14) continue.
14. Changes, law and disputes
- We may change these terms for good reason (for example when the product or the law changes). We will tell you before important changes take effect, and you may stop using your Geek if you disagree.
- These terms are governed by [FILL: governing law]. Consumers in the EU keep the protection of the mandatory law of the country where they live. Disputes go to [FILL: courts]. [LAWYER: EU online dispute resolution and mediation wording.] [LAWYER: US arbitration and class-waiver terms, if any; consider state rules on older consumers.]
- If a part of these terms is invalid, the rest still applies.
